À quoi ça ressemble, être photographe pendant le Festival d’été de Québec, un des plus importants festivals de musique au monde? Québec sur demande a posé la question à 3 photographes, dont moi!
La nouvelle circulait depuis hier, mais tant qu’une source sérieuse n’avait pas confirmée, j’ai préféré rester loin de cette nouvelle. Mais le Rolling Stone a enquêté et Axl Rose a bien complété un DMCA takedown notice pour faire supprimer d’Internet les fameuses photos qui ont depuis été transformées en « meme » pour rire de son surplus de poids.
La photo a été prise par Boris Minkevich du Winnipeg Free Press lors d’un concert des Guns au MTS Centre.
Le DMCA takedown notice n’est recevable que s’il est demandé par le titulaire du droit d’auteur. L’hébergeur du site Internet est alors dans l’obligation de retirer la photo, à défaut de quoi il sera codéfendeur dans une poursuite de violation du droit d’auteur. C’est généralement suffisant pour que la photo soit retirée.
La question importante est donc: est-ce que Boris Minkevich, sous la recommandation du Free Press, a signé un release donnant le copyright au groupe? C’est le genre de release qui est de plus en plus requis pour avoir le privilège de photographier des concerts et s’il a été signé, alors Axl aurait légalement le droit de le faire. Par contre, il aura une probablement droit à une bonne dose de Streisand effect..
Vous pensiez que ce n’était pas important, ces releases?
It used to be that you could photograph the whole show. That you could go on stage and take some amazing photos. But concert photography has changed and now the norm is that you can photograph three songs and then your out. Sometimes only two. Or one. Or only 30 seconds.
I can totally understand that. The photo pits are crowded with all the blogs and whatnot– we where 30+ at Metallica for their Festival d’été de Québec concert – and we are in the security’ and paramedics’ way.
Usually, after three songs, you have some good keepers and you can tell the story of the show. And if you are working on a deadline, you have to leave and transmit anyway.
But sometime, you really miss a piece of history with that rule. Metallica was playing in front of 130,000 in Quebec city, a place that the band have a particular relationship with, dating from a very long time. The crowd was still chanting their name during the main event when they where the opener in their early years.
It was their last show of the summer. In front of a HUGE crowd that they thanked for a good ten minutes. Then they lined up, holding each other’s by the shoulder, smiling and waving, genuinely amazed by the reaction of the crowd. I think I even saw James Hetfiel swiped a tear. This is a photo you will never see.
